The CME (Children Missing Education) guidance is statutory because there is a clause in the original act which directs the relevant authority to take note of the contents of any guidance issued. Guidelines are not statutory, and are basically just advice as to how to carry out particular duties.

GuidANCE trumps guideLINES.

As I understand it, HE cannot have statutory guidance because there is nothing in statute which refers an authority to any guidance. So to have statutory HE guidance we would need a change to the primary legislation.

It seems to me that this would not be a good thing, as each new guidance issued alters the legal situation - if I have misunderstood this PLEASE tell me, and explain to me how.

We have a situation where the 2007 HE Guidelines specifically state "The guidance issued makes it clear that the duty does not apply to children who are being educated at home." This was in relation to CME and pointed to the 2007 guidance on CME....continued...

New guidelines can only make matters worse for home educators in England and certainly won't make things any better.

Perhaps the authors are afraid to admit their involvement in this shadowy scheme. Could it be because some of them believe that not all parents should be allowed to home educate - a convenient 'pull the ladder up' sentiment that will appeal to govt?

There have been a number of messages sent to Tech's blog post implying that she confused the 1995 regs with the 2006 regs re the legislation around deleting a childs name from the register on reciept of written notification from the parents
The Education (Pupil Registration) (England) Regulations 2006

Deletion from roll (SCHOOL-AGE PUPILS)

Regulation 8(1) says that you can remove a name when:

(a) the pupil is registered at a school named in a school attendance order, and the local authority substitutes another school for the one named in the order, or revokes the order because arrangements have been made for the child to be educated otherwise than at school

(b) the pupil has been registered at another school, other than when the school agrees to registration at more than one school, in a case falling within (a) above or where a child of no fixed abode is dual-registered

(c) the pupil is registered at more than one school and has ceased to attend the school, and the proprietor of any other school at which s/he is registered has given consent to the deletion, other than when registration at more than one school is agreed, in a case falling within (a) above or where a child of no fixed abode is dual-registered

(d) the pupil has ceased to attend a school and the proprietor has received written notification from the parent that the pupil is receiving education otherwise than at school
