How can we stop this sort of thing? I don't think we can...

If the law doesn't suit it is just ignored. If evidence is needed it is made up

Reckon the only sensible ploy is to raise general awareness of the issues as the databasing of every citizen advances.

Leicestershire seems to quote the guidance directly although the lovely "monitoring" is mentioned!

"The duty does not apply to children / young people who are being educated at home. Monitoring arrangements already exist for children being educated at home."

Can these documents be collated and sent directly to Michael Gove? Wasn't he asking for ultra vires practices to be sent to him? Or was that someone else?

Suffolk are able to understand the law so why can't others?

agreed!

I think any noise we make directly to LAs can only be a case of fussing over inappropriate terms such as 'monitoring'... The CME guidance remains our anathema!

The fact is that if

... it still means that any child who is not registered as such *IS* CME... therefore we have 'licensing & monitoring' of home educated children as a result (no Badman Bill required)!... afterall, who the heck else is it referring to... travellers?

A post on the HE-UK list has confirmed the Suffolk thing. Apparently the previous HE person died, so exactly what we all fear has happened there with new people and a new approach. They seem keen on visiting for spot checks - hopefully enough people will tell them to &*£$ off and they'll get the message.

'What is meant by the term 'Missing Education'?
Children or Young People would be deemed to be missing education if they are of compulsory school age (5 - 16) and fit into at least one of the following criteria:

They are not on the roll of a school (either within Local Authority control or Independent)
They are not accessing any other form of alternative provision. This would cover children & young people receiving education at home monitored by the Local Authority. It would also cover County funded alternative provision such as college placements or work experience
Children or Young People would be deemed to be at risk of ‘Missing Education’ if they have been out of their educational provision for a period of four weeks or more.'

So all HE kids in Lancs are classed as CME ! It shows what info is passed by health, etc to the CME team - not sure it's all justified/necessary even for genuine CME cases.

Re Lancashire: the grammar is not clear but it looks to me that they are saying all EHE children are missing education unless they are receiving education at home that is **monitored by the Local Authority**
